1.0 Definitions 

1.1 “Company” refers to Endurequip Services Pty. Ltd.
1.2 “Customer” refers to the entity purchasing parts from the Company.
1.3 “Parts” refers to all products sold by the Company, specifically including parts for Endurequip & Finkbeiner hoists.
1.4 “Order” refers to the Customer’s request for Parts.

2.0 Order Acceptance

2.1 All Orders are subject to acceptance by the Company.
2.2 The Company reserves the right to refuse any Order without providing a reason.

3.0 Pricing

3.1 Prices for Parts are as per the Company’s current price list at the time of Order placement.
3.2 Prices may be subject to change without prior notice.
3.3 All prices are exclusive of GST unless otherwise stated.

4.0 Payment Terms

4.1 Payment for Parts must be made in accordance with the agreed payment terms.
4.2 If no payment terms are agreed, payment is COD (account customers only within 30 days of end of month).
4.3 The Company reserves the right to charge interest on overdue invoices at a rate of 2% per month.

5.0 Delivery

5.1 Delivery times are estimates and may vary based on availability and location.
5.2 The Company is not liable for any delay in delivery or failure to deliver due to circumstances beyond its control.
5.3 Risk in the Parts passes to the Customer upon delivery.
5.4 Delivery charges will be applied as per the Company’s standard rates unless otherwise agreed.

6.0 Returns and Exchanges

6.1 Parts may be returned within 14 days of delivery subject to the Company’s return policy.
6.2 Parts must be returned in their original packaging and condition.
6.3 The Company reserves the right to refuse returns or charge a restocking fee of up to 20% of the purchase price.
6.4 Special order Parts or custom items are non-returnable.

7.0 Warranty

7.1 Parts are covered by the manufacturer’s warranty.
7.2 The Company’s liability under the warranty is limited to the repair or replacement of faulty Parts or a refund of the purchase price.
7.3 The Company does not provide additional warranties beyond those offered by the manufacturer.

8.0 Liability

8.1 The Company is not liable for any indirect, consequential, or incidental damages arising from the use or inability to use the Parts.
8.2 The Company’s liability is limited to the cost of the Parts purchased.

9.0 Governing Law

9.1 These terms and conditions are governed by and construed in accordance with Australian law.
9.2 Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts of Australia.

10.0 Amendments

10.1 The Company reserves the right to amend these terms and conditions at any time.
